Definitions

Parkit: Parkit is a parking company whose main purpose is to provide parking services on private and public parking spaces that it manages. Parkit delivers Parkit's Parking service to the open market.

Service: parkit has a platform that offers the sale of parking permits and other products, the sale of access to charging stations and information on parking and other related information. The description includes the user interface, the central server that processes the data and the application-specific services offered by third party providers (e.g. payment and text).

App: the service is offered to users in the form of a mobile device app for iOS and Android operating systems and a website.

Users: these are the people who use the service. These are mainly personal users, but there can also be other types of users (such as Parkit administration, companies).


Purpose of Parkit's services

Parkit is a digital service for selling licences, selling time at charging stations and selling other types of products. The service is open and available to everyone.

Integrity

Collection of personal information and authentication

The user has the option to add some information to the solution, but Parkit uses the mobile number to verify a user.

Third-party SMS solutions are used to verify users. SMS are sent from third parties to users. After authentication, Parkit will use a token for authenticated users in further communication. Third party solution is also used for payment.

Storage of user information

The following user-related information may be stored in the Service:

Mobile number. This is used as the user identifier in the service and is linked directly to the app user's mobile station(s).

Credit card number. e Some digits from the card number are used for the Customer to identify which of their payment cards are registered in the Service.

Personal information. Purchases, Purchase History, Domain Address may be stored to associate the user with the right to purchase address-related products. In addition, date of birth and contact information can be stored in the solution.

Vehicle registration number. Stored in connection with the purchase of parking or other permits to attach a license to a vehicle.

Personal settings.

The user can configure the settings for the app (e.g. notification settings).

Technology. In use, technical information may be recorded around the mobile device (e.g. device and operating system type) and IP address. This information is only used for technical follow-up of service and support. Analysis tools are used in the statistics service,error reporting and usage pattern analysis. All such information collected is anonymised and used for statistical purposes.


Companies that use analytics tools on their website must ensure that the processing of personal data complies with the privacy policy. This means that:

After collection, IP addresses are anonymised or changed so that visitors cannot be traced back to a specific piece of hardware and thus to an individual. In Google Analytics, the anonymisation function must be enabled.

The processing of collected information shall only be used for statistical purposes. The business must not collect more information than is necessary for this purpose.

Parkit's procedures for personal data are secure and the information is kept in an accurate manner so that it is not used unlawfully.The confidentiality and availability requirements of personal data are respected.

What the information is used for

Create an effective service. The main purpose of the user information provided in the previous chapter is to facilitate an efficient service. Ensure that the purchase of permits and products is done in an efficient and secure manner.

Continuous improvement of the service. The information stored about the user will be used to improve the service, both to detect errors and to improve the customer experience. Parkit has the right to contact the user to improve the service, for example in the form of surveys. Participation in such surveys is voluntary.

Analyse the market and understand trends. usage patterns and how activity and trends are evolving. Analytics can also be combined with data across Parkit's digital spaces.

Customized offers. Parkit may offer advertisements, promotions, other specific offers, recommendations or advertising based on usage patterns or based on the user's customer segment. The user has access to the functionality of the app to disable this type of communication.

Prevent littering. Parkit monitors the solution's activity and can respond to suspicious transactions identified through usage patterns or through reports from other users.


Who can access the information

Third-party providers will receive the information necessary to perform a user's authentication, make payment transactions in order to make entries in data files. See description in previous section.

Parking operators, municipalities or other operators enforcing parking regulations at locations where the service is available will be able to determine whether the brand has a valid permit.

At the request of public authorities (e.g. Police, tax authorities) - where they have the legal authority to require information from the service - Parkit will be able to provide the requested information.

Parkit may provide data for research-related purposes. Data on individuals must be anonymised or data provided at an aggregate level.

We do not provide registered information about you to other organisations or companies without your voluntary, explicit and informed consent. If you give such consent, we will only disclose the information in accordance with that consent.


Data processors and proprietary information management

We may subcontract (partner) the technical part of data processing. The data processor shall, in agreement with us, process your personal data in the manner we determine. We instruct the data processor to ensure proper information security and deletion of personal information.

To delete your own user, please contact Parkit (see first part of this document). The user will then be deleted from the service, but the purchase transactions will be retained for up to 5 years to meet information requirements as a result of the provisions of accounting rules and regulations.

Terms of use for the service

This Agreement is entered into between Parkit as the provider of the Service and the User ("Customer") and governs the rights and obligations of the parties through the use of the Service. The Customer must accept this Agreement in order to use the Service. The Agreement is accepted and entered into by the Customer agreeing to the terms and conditions by providing approval in electronic dialogue before the Service is put into use.

§ 1 Parkit Sweden AB's commitments

1.1 Parkit Sweden AB, hereinafter "Parkit", provides parking for a fee. Parkit directs the customer where to park the vehicle and in some cases provides parking permits or pass articles. Parkit reserves the right to direct the customer to another parking space in the event of renovation work or similar. Parkit is not liable for damage to or break-in of vehicles in the parking space provided by Parkit.

§ 2 Customer's obligations

2.1 The Customer undertakes to park in accordance with Parkit's instructions and signage at the designated parking facility (indicated on the front of the invoice). The Customer may only use the parking space for the parking of one (1) vehicle. The vehicle may not be other than one (1) passenger car (not a camper van) unless otherwise agreed in writing. Only one (1) vehicle per parking space may be parked. The Customer must ensure that, where applicable, gates and door(s) are closed and locked after passage. The Customer does not have the right to allow unauthorised persons to enter the locked parking facility unless otherwise agreed in writing.

2.2 The Customer undertakes to comply with the parking facility regulations in force at all times. The Customer is not entitled to carry out car washing or car repairs in the parking facility. Customers who, by special agreement, have access to a parking space with an engine heater are not entitled to use the engine heater for any purpose other than the temporary heating of vehicles. The customer is responsible for cleaning, snow removal and sanding of the parking lot.

§ 3 Parking permits, digital parking permits and passing article"

3.1 For those customers who receive a parking permit or pass, the following applies: a parking permit is a document of value that is valid subject to payment for the period. The customer undertakes to place the valid parking permit clearly visible on the left in the front window of the vehicle when parking or the registration number of the parked vehicle must be updated in the ParkIt app. If the valid parking permit is missing from the vehicle when parked or is not placed as required, this may result in an inspection fee being issued. Parkit does not replace lost parking permits.

3.2 For digital permits, the customer undertakes to add the registration number(s) he/she uses under the "My Parking" tab in the "My Account" portal at www.Parkit.se. Failure to register or incorrect registration in "My Account" may result in the issuance of a control fee.

3.3. Passing article used for entry and exit in parking facilities. It is the responsibility of the customer to immediately notify the Parkit customer service of the loss of the access equipment. The customer is responsible for all costs that may arise as a result of careless handling of the accessory.

3.4 In the event that the customer does not use the access article when entering and exiting, Parkit has the right to charge the customer one hundred and fifty (150) SEK/occasion.

3.5 If the contract is terminated due to termination or any other reason, the customer is responsible for returning the received fitting article at the time of termination. Return must be made by registered mail or in the enclosed reply envelope. If Parkit has not received the article within one (1) week after the termination of the agreement, Parkit has the right to charge the customer for the costs incurred.

§ 4 Contract period and termination, change of conditions"

4.1 This agreement is valid for the contract period agreed by the parties at the time of the conclusion of the agreement (stated on the front of the invoice). Termination of the agreement must be made in writing, by e-mail or by form at www.Parkit.se at least one (1) calendar month before the end of the current contract period, unless otherwise agreed in writing. Otherwise, the contract is automatically extended for the same period each time. In the event of termination, the customer number must always be stated. Parkit always reserves the right to terminate the agreement according to the agreed notice period.

§ 5 Payment

5.1 The fee plus VAT at the applicable rate from time to time shall be paid against invoice by the due date. In the event of late payment, the customer shall pay interest in accordance with the Interest Act (1975:635) and compensation for a written reminder in accordance with the Act (1981:739) on compensation for collection costs, etc. Compensation for the reminder shall be paid at the amount applicable at any time in accordance with the Regulation (1981:1057) on compensation for collection costs. The customer is obliged to pay the full fee for each commenced contract period. Parkit has the right to change the fee for a new contract period. Changes in fees must be notified at least one month in advance.

5.2 Parkit reserves the right to charge a billing fee. In the event of late or non-payment, default interest will be charged in accordance with the Interest Act.

5.3 Om betalning för tillstånd, hyrd eller reserverad plats uteblir, betraktas parkeringen som inaktiv på grund av obetald avgift. I sådana fall har Parkit rätt att utfärda en kontrollavgift för otillåten parkering på fordonet.  

§ 6 Personal data

6.1 Parkit intends to process data such as name, personal identity number, address, telephone number, etc. of the Customer in order to fulfil its obligations under this Agreement, such as the provision of services, administration, customer service and invoicing.

6.2 The Customer has the right to request that inaccurate data relating to him/her be corrected, restricted and, where appropriate, deleted. The customer also has the right to data portability, to receive free information about the customer data once a year and to lodge a complaint with the Data Protection Authority. Information on the handling of personal data can be found at www.Parkit.se under "privacy policy".

§ 7 Assignment

7.1 The Agreement may not be transferred without the written consent of Parkit. No assignment will be accepted until the withdrawing customer has settled all his debts to Parkit.

7.2 The Customer does not have the right to make a parking space available to another person unless otherwise agreed in writing.

§ 8 Breach of contract etc.

8.1 Parkit has the right to terminate the agreement with immediate effect in writing in the event of late payment or if the customer breaches the terms of this agreement in any way. Parkit is also entitled to terminate the agreement with immediate effect in writing if the customer has suspended payments, initiated composition proceedings, gone into liquidation, been declared bankrupt or shown other clear signs of insolvency.

§ 9 Dispute

9.1 Disputes arising out of this Agreement shall be settled by a court of general jurisdiction in accordance with Swedish law.

§ 10 Force majeure

10.1 Parkit is released from the obligation to fulfil its part of the agreement and from the obligation to pay damages if obligations cannot be fulfilled at all or only at an abnormally high cost due to Swedish or foreign law, Swedish or foreign government action (e.g. fuel restrictions), an act of war, terrorist attack, fire, explosion, strike, blockade, boycott and lockout or other similar circumstance. The reservation in respect of strike, blockade, boycott and lockout also applies if Parkit itself is subject to or takes such conflict action.

§ 11 Online purchase

11.1. When purchasing online at www.Parkit.se an agreement is concluded between the customer and Parkit Sweden AB, org.nr 559301-5968, Varuvägen 9, 125 30 Älvsjö Stockholm, hereinafter "Parkit".

11.2 The terms and conditions set out below apply, mutatis mutandis, in conjunction with paragraphs 1 to 10 on page 1.

11.3. When an agreement is made according to paragraphs 2 and 3, Parkit will make the parking space available to the Customer at the time chosen by the Customer and

parking facility. Parking takes place in the parking facility chosen by the customer from the selected start time. The parking space is unreserved. Parkit reserves the right to direct the customer to another parking facility.

§ 12 One-off purchases and subscriptions

12.1. Parkit provides the Customer with a parking space for the parking of a passenger car (not a motorhome) for a one-off purchase or subscription fee. The offer of

parking space can be found on the website www.park-it.se

12.2. Once the payment has been made, a confirmation of the right to use a parking space will be sent to the e-mail address/customer's account provided. Parkit saves these data, the customer is requested to either print the confirmation himself or to save the confirmation

sent by e-mail.

12.3. The right to use a parking space is acquired when the customer accepts the invoice, the general terms and conditions, the storage of personal data and the payment received by Parkit. A final agreement between the parties has been concluded when Parkit has e-mailed the confirmation to the e-mail address/customer's account indicated by the customer. It is the responsibility of the customer to take note of the information on how to find the parking facility presented by Parkit in the booking dialogue and the confirmation. The agreed price is valid for the parking space paid in the selected parking facility.

12.4. If a parking permit is required and it is missing from the vehicle when it is parked or is not placed as required, this may lead to the issuing of an inspection fee. This also applies to exceeding the time paid.

§ 13 Payment of one-off purchases

13.1. In the case of one-off purchases, a parking fee is payable, the amount of which depends on the parking facility chosen and the period for which the parking space is reserved.

13.2. The parking fee shall be paid at the time of the Customer's booking in accordance with paragraph 2.2.

13.3. The right to use a parking space expires if the card company does not authorise the card transaction.

13.4. In the event that the passenger car (not camper) is collected before the end of the booking period, no refund will be made for the time not used.

13.5 In the case of one-off purchases, the Customer may cancel at any time up to 24 hours before the agreed start of the booking period. Cancellation is free of charge and is carried out via the website www.Parkit.se. If the cancellation is made less than 24 hours before the start of the booking period, no refund will be made.

§ 14 Subscription

4.1 If the customer has chosen a subscription (long-term parking) when booking parking, §§ 3 - 5 on page 1 apply.

§ 15 Price

15.1. The stated price/monthly fee is in Swedish kronor including VAT.

15.2. Parkit reserves the right to make any price/fee errors, price/fee changes, printing errors and updating errors.

15.3. Parkit reserves the right to omit prices/fees, misspellings, misdescriptions and sold out products in e-mails.

§ 16 Personal data

16.1. Parkit intends to process data such as name, personal identity number, address, telephone number, etc. concerning the Customer in order to fulfil its obligations under this Agreement, such as the provision of services, administration, customer service and invoicing.

§ 17 other

7.1 The aforementioned terms and conditions have been specifically agreed between the parties and replace the general terms and conditions in the applicable section on page 1. In all other respects, page 1 applies together with the aforementioned terms and conditions between the parties.
